1. Products

All products sold by Ouriversaria Martins do Vale. are new and genuine, complying with Portuguese legislation. Prices are expressed in Euros (EUR) and include VAT at the legal rate in force.

2. Responsibilities

Ouriversaria Martins do Vale is not responsible for damages caused to the Customer during the use of the Internet network, such as: interference, external intrusions, interruptions, computer viruses, malfunctions or disconnection of the computer system or any other case of force majeure.

3. Customer/User Obligations

The Customer/User must comply with these general conditions and respect them. In particular, it undertakes to fulfill the following obligations:

1.Save and not disclose your Username and Authentication Password in the Online Store, in order to prevent third parties from accessing your account;

2.Do not use false identities;

3.To provide personal data and correct addresses, so that Ouriversaria Martins do Vale can properly process orders.

4. Online ordering

5. Availability of products

Ouriversaria Martins do Vale only dispatches orders on working days. In this way, neither weekends nor holidays are taken into account for the estimated delivery of orders.

All products are subject to existing stock. In the event of a temporary or permanent break in stock, the customer will be informed and, whenever possible, suggested an alternative for products with similar characteristics. If this is not possible, the money will be refunded in full, without any additional cost.

All prices indicated are in Euros with VAT included at the legal rate in force, and an invoice for the products purchased will be sent along with the order.

6. Shipping expenses

Shipping costs are borne by the customer for purchases of less than €30, with a cost of €5, being free for purchases of €30 or more, for shipment in Portugal  The product is packed with care to avoid damage during transport to ensure full customer satisfaction.

7. Exchanges and Returns

Within the scope of its Customer Satisfaction Policy, and under the applicable legal terms,  Ouriversaria Martins do Vale allows the exchange or return (contract termination) of products within 15 days from the date of receipt by the Customer,

To exchange or return the product, the customer must follow the following steps:

1. Contact Ouriversaria Martins do Vale. via email geral@martinsdovale.com

2. After contacting, the Customer must send the product to Ouriversaria Martins do Vale, at Rua Machado dos Santos 89, 9500-083 Ponta Delgada

The return and exchange of products must comply with the following conditions:

• Return of products in good condition, without any sign of use, with original and complete packaging and other elements that accompany the product, namely: warranty certificates, protective films and security labels;

• Any exchange or return must be accompanied by the respective invoice;

• Exchanges of customized products according to the Customer’s specifications are not accepted (rings and alliances made to the customer’s requirements, engravings, etc…);

• In the case of sending the product, it is the responsibility of the Customer, namely costs, loss, damages that he may suffer during transport and delays.

All products will be checked upon arrival at our service and only those that comply with the exchange conditions will be accepted for exchange.

Ouriversaria Martins do Vale reserves the right not to accept products that do not meet these conditions.

8. Warranty and after-sales assistance

All products sold by Ouriversaria Martins do Vale are covered by a 2-year manufacturer’s warranty, guaranteed by the respective brands. (Official Brand Warranties).

In the event that the product purchased has a manufacturing defect, you must first notify the Ourversaria Martins do Vale via the email geral@martinsdovale.com , informing your order number and the description of the anomaly. The costs of sending products within the scope and within the Warranty period will be borne by Ouriversaria Martins do Vale.

Upon receipt of the product at the facilities of Ouriversaria Martins do Vale, a technical verification will be carried out if the defect is proven within the scope of the warranty, the product will be sent to the Technical Assistance, and it will be repaired free of charge or will be replaced by a similar model in cases where recovery is not possible. Subsequently being sent to the Customer to his address at no additional cost.

If the technical verification detects that the repair of the defect is not covered by the warranty (eg drop, etc.), the Customer will be contacted to indicate whether he wants the product to be repaired, with the repair and shipping costs will be borne by the Customer. In these situations, if the customer does not wish to have the product repaired, the shipping costs will also be borne by the customer.

9. Watch Warranty Restrictions

In all watch brands sold by Ouriversaria Martins do Vale.

1.    The Warranty is not valid for the bracelet, batteries and glasses.

2.    The Warranty also does not cover breakdowns or damage caused by normal wear and tear caused by use, accident, misuse or neglect, such as wear on the bracelet, broken or scratched glass or broken crown.

3.    We ask you to pay special attention if your watch has stones or crystals on the outside.

4.    These watches should be treated with the care necessary for a piece of jewelry, as less careful handling could lead to the stones or crystals coming loose. The guarantee does not cover the loss of stones or any damage caused by the watch to the clothing.

5. Whenever your watch has stones on the outside, it should be kept away from water, perfumes or other liquids that may interact and discolor or stain the stones or even compromise their fixation.

6.    The water resistance of your watch differs depending on the model and is indicated on the case cover. Check the table below for the correct use of your watch depending on its resistance.

Always bear in mind that the crown must be in its normal, tightened position, in order to guarantee the advertised water resistance. Never adjust your watch or use the knobs or rotating bezel when your watch is wet.

When the battery of your watch is changed, it is also necessary to change the seal on the cover, otherwise the watertightness of your watch may be compromised.

If there is recourse to the warranty, the period of this is not extended as a result of the possible exchange of parts.

In all jewelery brands, materials subject to breakage (glass and stones), loss, oxidation, deterioration, defects caused by blows, including deformations caused by daily use and/or inappropriate, inadequate conservation and cleaning are excluded from the warranty. , neglect, mishandling, modifications, unauthorized repairs, accidents or normal wear and tear.

10. Certifications

All articles in precious materials sold by Ouriversaria Martins do Vale, are made complying with all quality criteria, duly certified by the Contrastaria da INCM.
The INCM Contrastarias provide this guarantee through the verification of the legal touch (permillage of precious metal contained in an alloy) and the application of the contrast next to the responsibility mark, of manufacturer or equivalent”. The application of the marks is only mandatory on pieces weighing more than 2 grams.

11. Usage Recommendations

Avoid contact with abrasive products or situations, namely cosmetics, detergents or perfumes.
Avoid other situations of excessive wear that occur especially in the case of rings.
Pack the pieces carefully to avoid friction with other pieces, or knots, in the case of wires.
Avoid playing sports with the pieces. Perspiration and chlorine do not contribute to the durability of the parts.
Occasionally clean parts with a soft, dry cloth.

 

12. Applicable Law

All purchases made on the site are subject to Portuguese legislation. Any conflict or divergence of interpretation of the General Conditions of Contract and Use will be submitted to the competent Portuguese Court.
If our client is outside mainland Portugal, we inform you that any legal proceedings must be referred to the Portuguese Courts.

The company Ourivesaria Martins do Vale e Irmão, Lda, hereinafter referred to as Ouriversaria Martins do Vale, declares to join the Arbitration Court of the Consumer Information and Arbitration Center of Ponta Delgada, accepting Arbitration as a way of resolving consumer disputes arising from sales of goods and services carried out in Ponta Delgada.

He also declares that he accepts the decisions that may be taken by the Referee Judge.
